Terms of Service

These Terms of Service (“Terms”) are an agreement between you and NextTrip (“NextTrip,” “we,” “us,” or “our”) governing your use of the NextTrip app and website (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

Who can use NextTrip

You must be at least 18 years old (or the age of majority where you live) to create an account. You’re responsible for your account and for keeping your password secure. You may add family members — including children — as names and details within your private household list, but those people are not account holders.

What NextTrip is

NextTrip is a private app for keeping a shared list of places you want to go and trips you’ve taken, with photos and milestones. It is offered for personal, non-commercial use. The Service is provided as it is today; features may change, and some described features may be in development.

Your content

You keep all rights to the content you add — your lists, notes, photos, and the people and events you record (“Your Content”). You grant us only the limited permission needed to host, store, back up, and display Your Content to you and your household, so the Service can work (for example, syncing it across your devices). We don’t claim ownership of Your Content and we won’t sell it or use it for advertising. You’re responsible for making sure you have the right to add the content you upload (including photos of other people).

Acceptable use

Please don’t:

• Use the Service for anything unlawful, harmful, or abusive.
• Upload content that infringes someone else’s rights or violates the law.
• Attempt to access other users’ data, break security, or disrupt the Service.
• Reverse-engineer, resell, or misuse the Service.

We may suspend or end accounts that violate these Terms or put the Service or its users at risk.

Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we handle your information.

Third-party services

The Service relies on third parties (such as our hosting provider, app stores, and a map/places search provider). Your use of those parts may also be subject to those providers’ terms, and we aren’t responsible for their services.

Availability and changes

We work to keep the Service running, but we don’t guarantee it will always be available, uninterrupted, or error-free. We may add, change, or remove features, and we may update these Terms from time to time. If we make material changes, we’ll update the “Last updated” date and make a reasonable effort to notify you. Continuing to use the Service after changes means you accept the updated Terms.

Ending your use

You can stop using the Service and delete your account at any time (see Support). We may suspend or terminate access if you violate these Terms or if we discontinue the Service.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We don’t warrant that the Service will be error-free, secure, or always available, or that any content will be preserved or accurate. You use the Service at your own discretion and risk, and you’re responsible for keeping your own copies of anything important to you.

Limitation of liability

To the fullest extent permitted by law, NextTrip and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, content, profits, or goodwill, arising from your use of (or inability to use) the Service. To the extent we are found liable, our total liability will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD $50.

Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there for any disputes, except where prohibited by applicable law.
